I think it's because it was excessive and driven by personal emotions. You don't need to bash someone to death with the edge of your shield to apprehend them, he already had him pinned to the ground. The killing wasn't motivated by a desire to protect those around him, but rather to take out his emotions which is not the kind of thing you want someone who has so much responsibility as a superhero to do. Especially in broad daylight with everyone around to see. It isn't a problem that a superhero took a life, because sometimes taking the life of a villain is the only way to protect the life of an innocent, or protect yourself from being killed. But that's not what happened here, which is why it is a problem.

Considering how public the launch of his brand as the new Captain was it's likely he had people show up to his home protesting the fact that he wasn't in prison.
